You ordered one product, opened the package, and found something else. Now your money is stuck while Amazon’s support team asks you to wait, repeats the same response, or says it cannot issue a refund. That is frustrating, especially if you have already returned the item. You do have options. This guide explains what proof to save, how to press Amazon for a clear answer, and when to move your complaint to the National Consumer Helpline or a consumer commission.

First, protect the proof that shows what went wrong

Before another call or chat, put everything about the order in one folder. A wrong-product dispute often turns on a simple comparison: what the listing and invoice say you bought versus what arrived. If the item has already been collected, your return records become just as important. You do not need perfect evidence, but you should save what you can while the listing, order page and support messages are still available.

Take clear photos of the item from several angles and keep its accessories and packaging until the return is settled. If you have not handed it over, ask the pickup person for a receipt or make sure the collection appears in your order tracking. Do not give away the item without pickup proof. If a pickup has already happened and you received nothing on paper, save the app status, text messages and any chat confirming collection. Write down the pickup date and the complaint ID now, while you can still recall them accurately.

An unboxing video helps, but not having one does not mean you should give up. An invoice, photographs, messages and return records can still tell a consistent story. Keep original files where possible rather than relying only on images forwarded through chat. This is also the starting point for a consumer refund complaint: a short, documented account is easier to act on than a long argument with no order details.

Does a wrong product give you a right to a refund?

Yes, a product that does not match what was ordered can give you grounds to seek a remedy. The exact legal basis depends on what happened: the goods may be defective in the legal sense, the service may be deficient, or the sale may involve an unfair trade practice. You do not have to decide which label fits before you first complain to Amazon. Describe the mismatch accurately and say what you want done about it.

The Consumer Protection Act, 2019 covers online purchases under section 2(7). Sections 2(6), 2(10), 2(11) and 2(47) are relevant to complaints involving defective goods, deficient service or unfair trade practices, depending on the facts. If you eventually file a consumer complaint under section 35, the commission can, where justified, order remedies including replacement, refund with appropriate interest, and compensation under section 39(1)(b) to (d). These are possible remedies, not automatic additions to every refund.

The Consumer Protection (E-Commerce) Rules, 2020 also matter. Rule 6(3) prevents a marketplace seller from refusing a return or refund when goods lack the agreed or advertised characteristics; rule 7(4) addresses sellers operating under the inventory model. In plain terms, “our system will not allow a refund” is not, by itself, a satisfactory explanation when the delivered product differs from what was sold. The facts and your evidence still matter, so make the difference between the ordered and delivered models unmistakable.

You may be dealing with Amazon support, but note the seller named on the invoice as well. If you write a formal complaint or later file a case, identifying the relevant seller and platform correctly helps avoid confusion. Keep your request focused: a refund of the amount paid to the original payment method, or a replacement if that is what you actually prefer. If you are being offered store credit instead, say clearly whether you accept it.

Ask Amazon for a decision you can keep in writing

Start in the order’s help or return flow and select the option that most closely describes “wrong item delivered.” Do this promptly. Include the order ID, the product and model ordered, the product and model received, the delivery date, and photographs. Ask for a complaint ID and written confirmation of the proposed return and refund. If the app offers only a generic return reason, explain the actual mismatch in the text box or follow-up chat.

Do not rely only on phone conversations. After a call, send a short message through an available written support channel summarising what was agreed: “I reported receiving model X instead of model Y on [date]. Your agent confirmed [pickup/refund/next step]. Please confirm this in writing.” Save the response. If support gives you a new deadline, note who gave it and when. A clear record helps if the answer changes later.

If the return was picked up but the refund was refused

This is particularly stressful because the product is no longer with you. Ask Amazon to state the precise reason for refusal in writing and provide the records it relied on. Was the parcel marked lost in transit? Is Amazon claiming that the returned item did not match? When and where was that finding made? Attach your pickup confirmation and earlier photos, then ask for a review of the decision. Do not accept an unexplained “investigation completed” message as the only answer.

In a Delhi consumer case concerning a laptop, the buyer paid ₹61,990, received an old IBM ThinkPad instead of the HP laptop ordered, and had a return pickup recorded. Amazon later said the parcel was lost in transit and denied the refund. The commission considered evidence including photographs, bank statements, return-confirmation screenshots and messages, and ordered the platform and seller jointly to refund ₹61,990 with 9% annual interest, plus ₹10,000 compensation and ₹7,500 costs. That result does not guarantee yours, but it shows why pickup and communication records are worth preserving.

Move beyond repeated support replies

If ordinary support stalls, send a written escalation to the grievance officer identified on the platform. The E-Commerce Rules require an e-commerce entity to have a grievance officer, acknowledge a complaint within 48 hours and redress it within one month. The 48-hour period is for acknowledgment, not a promise that your money will arrive within 48 hours. Rule 4(10) addresses payment of accepted refunds within a reasonable or otherwise applicable prescribed period.

Put the seller shown on your invoice in the escalation and ask for a final written decision. Use the National Consumer Helpline when Amazon does not resolve it

You do not have to keep starting the story from scratch with a new support agent. The National Consumer Helpline (NCH) offers a free way to raise the grievance with the company. File at consumerhelpline.gov.in, call 1915, or WhatsApp 8800001915. Upload the invoice, order and product photos, your Amazon complaint ID, the refusal or delayed-refund messages, and pickup proof if the item was collected. Keep the NCH docket number.

NCH is a pre-litigation route: it forwards grievances to companies and helps seek a response. It cannot issue the kind of binding order a consumer commission can. Companies participating in its convergence programme are expected to respond within 30 days, but a response does not necessarily mean a refund. Check the docket and save any reply, even if you disagree with it. That reply may clarify what Amazon says is missing or why it is refusing payment.

There is reason to try this step without treating it as a guarantee. NCH has published a consumer report in which an Amazon refund followed an NCH complaint. A government-reported case involving a different e-commerce platform also describes a buyer who received a three-star rather than a five-star refrigerator and recovered ₹17,490 after contacting NCH. Those are individual outcomes. Your strongest contribution is a concise complaint backed by the order and return trail.

If Amazon has stopped giving a meaningful answer, put your demand in one dated message. State what you ordered, what arrived, the price paid, when you complained, whether the wrong item was picked up, and why the refusal is disputed. Ask for the refund to the original payment method and a written response. Attach or refer to your key documents. A practical response window is 7 to 15 days; it is not a statutory notice deadline and sending a legal notice is not a prerequisite to filing a consumer complaint.

A brief demand could say: “For order [ID], I paid ₹[amount] for [ordered model] but received [delivered model]. I reported this on [date], complaint ID [number]. The return was picked up on [date], as shown by [proof], but my refund remains unpaid. Please refund ₹[amount] to my original payment method and provide a written decision within [chosen period].” Adjust it to your facts. Never claim a pickup occurred if it did not.

A professionally drafted notice can be useful when the amount is significant, the refusal is complex, or you want a documented escalation to the platform and seller. But it cannot compel payment on its own. A notice did not secure the refund in a Bengaluru case involving a buyer who sought ₹59,990 after receiving a different-model TV; the buyer pursued a consumer complaint. If there is still no refund, file a consumer complaint

When escalation has not worked, the District Consumer Disputes Redressal Commission offers a route to seek a binding decision. You can file through e-jagriti.gov.in or at the commission. e-Jagriti replaced the earlier e-Daakhil filing route in 2025. For a typical purchase, the District Commission handles matters where the amount paid is up to ₹50 lakh. That limit is based on what you paid for the goods or services, not the larger compensation figure you might request.

Section 34(2)(d) of the Consumer Protection Act allows you to file where you reside or work. The e-Jagriti portal lists no filing fee when the amount paid is up to ₹5 lakh. What to put in your complaint

  1. Identify the parties: Use the names and details from the order, invoice and relevant platform communications. Include the seller where appropriate.

  2. Set out the sequence: Give dates for the order, delivery, discovery of the mismatch, support complaints, return approval, pickup and refund refusal. If no pickup occurred, say so.

  3. Explain the mismatch: Compare the advertised or ordered item with the item received. Give model and serial details where available.

  4. Attach the proof: Include the listing, invoice, payment record, photos, chats, complaint IDs, NCH docket and return tracking.

  5. State the remedy sought: Request a refund or replacement, as appropriate, and explain any claim for interest, compensation or costs. Ask for amounts you can justify.

Do not wait indefinitely for another “final investigation” if the problem remains unresolved. Section 69 ordinarily gives you two years from the cause of action to file a consumer complaint. If you are nearing that limit, seek advice promptly rather than assuming support conversations extend it. Filing starts a process; it does not mean the commission will decide the case immediately.

For cases that do not need product testing, section 38(7) sets a target of three months after the opposite party receives notice. That is a target, not a guaranteed finish date. The Bengaluru case took about 10½ months from filing to order, while the Delhi laptop case took about 18 months. Your case may be shorter or longer. Keep copies of everything you submit and check the portal or commission for updates.

What should you do today?

If the wrong product is still with you, photograph it, save the listing and invoice, and report “wrong item delivered” in your Amazon order immediately. If it has been picked up, find the pickup confirmation before doing anything else. Then send one written escalation that gives Amazon the order ID, complaint ID, exact mismatch and refund request. Ask for a written reason if it refuses.

If that gets nowhere, raise the same documented complaint with NCH. Consider a dated demand or notice if a clear final request would help, then use e-Jagriti if the dispute remains unresolved.
