Kalpana Shantilal Shah v. Grofers India Pvt. Ltd. (Blinkit)
CC/35/2022 • South Mumbai District Consumer Disputes Redressal Commission
The consumer ordered household groceries via the Blinkit application. Upon delivery, an essential grocery item ('Tarboojmagaj' worth ₹31) was missing from the sealed bag. Customer support claimed their warehouse packing logs confirmed complete dispatch and refused a refund.
The South Mumbai District Commission held Blinkit guilty of gross deficiency of service under Section 2(47) of the Consumer Protection Act, 2019. The bench ruled that an aggregator cannot rely on unilateral warehouse dispatch entries to negate a customer's physical delivery deficit.
₹31 refund with 9% interest + ₹5,000 compensation for mental agony + ₹3,000 litigation expenses (Total ₹8,031+).
What it means for you:Blinkit cannot deny your refund simply because their app bot says "internal records show the item was packed." You are entitled to litigation costs and compensation even for low-value missing goods.
